This bill removes certain limitations on recovery for victims of certain sexual offenses. Specifically, it amends the New Jersey Tort Claims Act to remove immunity from civil liability for public entities or public employees for sexual assault, crimes of a sexual nature, prohibited sexual acts, or sexual abuse against a person, if caused by a willful, wanton, or grossly negligent act. It also removes the immunity for public entities for negligent hiring, supervision, or retention of public employees in cases where a minor under 18 was the victim. Additionally, the bill removes the recovery limits for pain and suffering damages in these types of actions against public entities or employees.
