The legislation declares a public policy aim of ensuring athletic opportunities for females and remedying past sex-based discrimination. Specifically, the bill prohibits students from competing in athletics designated for a biological sex different from their own, with a limited exception allowing female students to compete in male-designated competitions if no corresponding female competition exists. The bill mandates that birth certificate records must have been entered at or near birth or corrected for a scrivener's error to be considered valid. Institutions that violate these guidelines will lose state funding, and students or their guardians can seek legal remedies if athletic opportunities are denied. The bill removes a previous sunset provision that would have ended the law's effectiveness in 2027.
