AI Summary
This bill, named the "Judith Kaye School Solutions not Suspensions Act," aims to comprehensively reform school disciplinary practices in New York State. The legislation introduces significant changes to how schools handle student misconduct, emphasizing a more holistic, supportive, and proportionate approach to discipline. Key provisions include prohibiting suspensions for students in pre-kindergarten through third grade, except in extreme circumstances, and restricting suspensions for minor infractions like tardiness or dress code violations. The bill requires schools to use multi-tiered support systems, restorative practices, and positive behavioral interventions before considering suspension. When suspensions are necessary, the bill mandates creating comprehensive education plans to ensure students continue learning and can successfully return to school, with opportunities to complete missed assignments and earn academic credits. Additionally, the bill requires schools to consider a student's whole circumstances, including potential external factors that may impact behavior, and provides detailed procedures for suspension hearings, parental notification, and student rights. The legislation also introduces a new annual reporting requirement for school districts to track and analyze disciplinary actions, including detailed demographic breakdowns, to promote transparency and identify potential systemic disparities in school discipline.
