This bill establishes new provisions for distributed energy resources (DERs) in Oklahoma, defining key terms and creating regulatory exemptions. A distributed energy resource is defined as a small-scale electrical power source installed near its point of use, which can include power generation, energy storage, energy efficiency, or demand response resources. The bill provides an exemption for owners and operators of DERs who serve only their own load and are not connected to the public utility grid, freeing them from state and federal regulations, registration requirements, and fee payments. However, if an owner or operator wants to construct or maintain electric distribution lines in public rights-of-way, they must first obtain a performance bond equal to the value of the line and provide written notification to transmission and distribution utility providers at least 30 days before construction. If a public utility objects to the proposed distribution line, the Corporation Commission must conduct a full evidentiary hearing to determine whether the line would interfere with existing electricity delivery. If no interference is found, the owner or operator may proceed with construction after meeting the bonding and notification requirements. The bill is set to become effective on November 1, 2025, and aims to provide flexibility for small-scale energy producers while maintaining safeguards for existing utility infrastructure.
