This bill establishes a new reporting requirement for entities participating in the federal 340B Drug Pricing Program in Indiana. The 340B program, which is a federal initiative that allows certain healthcare organizations to purchase outpatient drugs at discounted prices, will now require covered entities with a service address in Indiana to submit detailed annual reports to the state department of health. These reports must include comprehensive financial and operational information, such as aggregate drug acquisition costs, payment amounts, number of prescription drug claims, use of program savings, charity care details, and total operating costs. The reports are due before April 1 each year and will cover the previous calendar year. By November 15, the state department will create an aggregated report summarizing the data and submit it electronically to the legislative council and post it on their website. Entities that fail to submit the required information will be subject to a fine of $1,000 per day the report is overdue. While the individual entity reports will be kept confidential, the aggregated report will be publicly accessible, providing transparency about how 340B program participants are utilizing their drug pricing benefits and supporting healthcare services.
