This bill creates the Vital Industries Security Act of 2025 and amends existing Oklahoma law regarding wind energy facilities by introducing several key provisions. The bill maintains existing setback requirements for wind turbines, which mandate that wind energy facility towers must be at least 1.5 nautical miles away from public airports, public schools, and hospitals. It continues to require that wind energy facilities obtain a Determination of No Hazard from the Federal Aviation Administration (FAA) and resolve any potential adverse impacts to the Department of Defense through the Military Aviation and Installation Assurance Siting Clearinghouse. The bill introduces a new provision that allows county commissions in counties hosting significant oil pipeline infrastructure to declare a moratorium on the construction or expansion of wind energy facilities within their jurisdiction. Failure to comply with the FAA and military impact documentation requirements can result in administrative penalties of up to $1,500 per day per violation. The bill will become effective on November 1, 2025, and is not intended to be codified as a permanent part of Oklahoma's statutes.
