Bill Summary

AN ACT to amend the executive law, in relation to directing contracting state agencies to develop a growth plan in order to increase participation of MWBEs with respect to state contracts and subcontracts

AI Summary

This bill directs state agencies to develop a three-year growth plan (instead of a four-year plan) aimed at increasing participation of minority-owned and women-owned business enterprises (MWBEs) in state contracts and subcontracts. The growth plans must include several comprehensive analyses, such as examining the use of discretionary buying and its potential to increase MWBE participation, exploring how to leverage resources from the Empire State Development Corporation and the division to facilitate MWBE involvement, and developing strategies to improve MWBE capacity to bid on and win contracts. The plans must also include an explanation of how agencies debrief MWBEs that lose bids, an analysis of contract waivers, and steps to reduce the need for such waivers. Each state agency will be required to submit these growth plans as part of their annual report to the governor and legislature, starting September 15, 2020. The bill modifies existing executive law to require these more detailed and proactive approaches to supporting minority- and women-owned businesses in state contracting, with the goal of increasing their meaningful participation in state procurement processes.
