This bill requires all New York state contracting agencies to develop a three-year (previously four-year) growth plan aimed at increasing participation of minority-owned and women-owned business enterprises (MWBEs) in state contracts and subcontracts. The growth plans must include several detailed analyses, such as examining the agency's use of discretionary buying and the percentage of purchases awarded to certified MWBEs, exploring how to leverage resources from the Empire State Development Corporation to facilitate MWBE participation, analyzing strategies to improve MWBE capacity to bid on contracts, explaining how the agency debriefs MWBEs that lose bids, and investigating the types of contracts where waivers are being granted. Agencies must submit these growth plans as part of their annual report to the governor and legislature, starting September 15, 2020. The bill also modifies reporting requirements to align with the three-year growth plan cycle, requiring agencies to include their MWBE contract goals, actual contract numbers, waiver summaries, and other relevant information in their annual reports. The legislation aims to enhance transparency and support for minority- and women-owned businesses in state contracting processes.
