This bill amends New York's agriculture and markets law to expand the definition of "land used in agricultural production" to include two new categories of farm operations. The first category covers farms with at least seven acres and annual gross sales of at least $5,000, or farms with less than seven acres and annual gross sales of at least $35,000. These farms must demonstrate the ability to meet gross sales requirements within three years of receiving an agricultural assessment. The second category includes newly established farm operations of at least seven acres in their first or second year of production that cannot yet meet sales requirements but can demonstrate potential to do so within five years. In both cases, the agricultural commissioner or advisory board will create metrics to assess the farm's potential, with special consideration given to farms that have received state or federal grants, particularly those supporting beginning farmers or economically and socially disadvantaged farmers. If a farm fails to meet the required gross sales value within the specified timeframe, it will no longer be considered land used in agricultural production. The bill will take effect one year after becoming law and will apply to assessment rolls prepared on or after that date.
