This bill amends the New York agriculture and markets law to expand the definition of land used in agricultural production by establishing two new categories of farms eligible for agricultural assessment. The first category includes farms with at least seven acres and annual gross sales of $5,000 or more, or farms with less than seven acres and annual gross sales of $35,000 or more, which must demonstrate the ability to meet gross sales requirements within three years. The second category covers newly established farm operations of at least seven acres in their first or second year of production that may not immediately meet sales thresholds but can demonstrate potential to achieve the required gross sales within five years. The bill requires the state commissioner or an advisory board to develop metrics for assessing a farm's potential, with special consideration given to farms that have received state or federal grants, particularly those supporting beginning farmers or socially disadvantaged farmers. Farms that fail to meet the gross sales requirements within the specified timeframes will lose their agricultural assessment status. The act will take effect one year after becoming law and will apply to assessment rolls prepared on or after that date.
