This bill modifies the Texas Health and Safety Code to expand who can request a public hearing from the Texas Commission on Environmental Quality (TCEQ) regarding the construction of a concrete plant. Currently, only residents within 440 yards of a proposed plant could request a hearing, but the bill increases this radius to 880 yards and adds that representatives from schools, places of worship, licensed day-care centers, hospitals, and medical facilities can also request hearings. The TCEQ will be required to establish rules defining who qualifies as a representative of these institutions. The bill will apply only to permit applications filed with the TCEQ on or after the effective date of the new rules. The act will take effect immediately if it receives a two-thirds vote in the Texas Legislature, otherwise it will take effect on September 1, 2025. This change aims to provide more opportunities for community stakeholders to participate in the permitting process for concrete plants and potentially address environmental or safety concerns.
