This bill modifies the rules for requesting a public hearing from the Texas Commission on Environmental Quality (TCEQ) regarding the construction of a concrete plant. Currently, only individuals residing within 440 yards of a proposed plant could request a hearing. The bill expands this to include representatives of schools, places of worship, licensed day-care centers, hospitals, nursing facilities, and medical facilities, and increases the radius to 880 yards. The TCEQ will be required to establish rules defining who qualifies as a representative of these institutions. The changes will only apply to permit applications submitted to the TCEQ on or after the effective date of the new rules. The bill will take effect immediately if it receives a two-thirds vote in both legislative chambers, or on September 1, 2025, if it does not receive the necessary immediate-effect votes. This change aims to broaden the opportunity for community stakeholders to participate in the environmental review process for concrete plant construction.
