Bill Summary
AN ACT to amend the real property law, in relation to the responsibility of a landlord to remediate pest infestations
AI Summary
This bill establishes comprehensive requirements for landlords regarding pest infestations in residential properties. The legislation defines a pest infestation as a breach of the warranty of habitability and mandates that landlords are responsible for preventing, investigating, and remedying pest problems. Specifically, landlords must conduct annual pest investigations (and more frequently if needed), maintain detailed records of these inspections, and use integrated pest management (IPM) techniques to eliminate pests. The bill provides specific work practices for addressing infestations, such as physically removing pest nests, sealing entry points, and eliminating water sources. The definition of "pests" is broad, including insects, arthropods, rodents, and other unwanted organisms that are destructive or nuisance-causing. Importantly, the bill stipulates that pesticide use cannot substitute for comprehensive pest management, and any pesticides must be applied by a licensed professional. The legislation also includes a provision that landlords are not liable for infestations caused by willful or intentional actions of tenants. Landlords must also include a conspicuous notice about pest management responsibilities in all lease agreements. The act will take effect 30 days after becoming law, with immediate authorization for preparing necessary implementing regulations.
