Bill Summary

AN ACT to amend the real property law, in relation to the responsibility of a landlord to remediate pest infestations

AI Summary

This bill establishes comprehensive requirements for landlords regarding pest infestations in residential properties. The legislation defines a pest infestation as a breach of the warranty of habitability and mandates that landlords must keep dwelling premises free from pests, prevent foreseeable infestations, and quickly remediate any pest-related issues. Landlords are required to conduct pest investigations at least annually or more frequently if conditions warrant, and must maintain detailed records of these investigations for at least five years. The bill specifies detailed pest management practices, including physically removing pest nests and debris, sealing potential entry points, and eliminating water sources for pests. Importantly, the bill broadly defines "pests" to include insects, arthropods, rodents, and other unwanted organisms that are destructive or nuisance-causing. While landlords are generally responsible for pest control, they would not be liable if the infestation is caused by a tenant's willful or intentional actions. The bill also requires landlords to use integrated pest management techniques and prohibits simply relying on pesticide application, mandating that any pesticides must be applied by a licensed professional. All leases must now include a conspicuous notice about these pest management obligations, providing transparency for tenants about their landlord's responsibilities.
