This bill amends the environmental conservation law to prohibit the aerial and ground application of malathion and certain pyrethroid-based insecticides within parks and within 100 feet of schools, day care centers, and parks. The bill defines these locations specifically: schools include public, private, and parochial schools and BOCES; day care centers encompass child day care and head start centers; and parks refer to state, county, or municipal parks. The legislation allows for an emergency exception where the least toxic pyrethroid pesticide can be applied, but only after approval from designated authorities like county health departments, health commissioners, environmental conservation commissioners, or school boards. Such emergency applications must be conducted at a time that minimizes children's exposure, include adequate public notice, and be accompanied by appropriate signage. If a more restrictive standard exists on a pesticide's label or in other regulations, that standard will take precedence. The department of environmental conservation is authorized to create rules and regulations to implement these provisions, and the law will go into effect 180 days after becoming law.
