This bill aims to protect children by prohibiting the aerial and ground application of two specific types of insecticides - malathion and pyrethroid-based insecticides (specifically resmethrin and sumithrin) - near areas where children are present. The bill establishes restrictions that prevent these insecticides from being used within 100 feet of schools, day care centers, and parks, and also prohibits their use on any property when children are commuting to or from school or engaging in outdoor activities. The legislation defines "day care centers" as including child day care centers and head start centers, and "schools" as public, private, parochial schools, and boards of cooperative educational services. If any other regulations or product labels have more stringent standards regarding these insecticide applications, those more restrictive guidelines will take precedence. The New York State environmental conservation office is authorized to create additional rules and regulations to implement this section of law, and the act will take effect immediately upon passage.
