This bill amends existing law regarding structures built over the state's waters, specifically concerning dwellings over water. It allows for the repair, reconstruction, or improvement of existing dwellings over water, provided they were legally constructed or converted at the time. These improvements can utilize modern technologies and can alter interior design or existing support structures (cribwork), but crucially, they cannot expand the dwelling's footprint or outside dimensions in a way that increases interior living space, with an exception for adding means of egress required by building codes. The bill also introduces a provision where the commissioner of environmental services may waive existing standards to allow for an expansion if the repair, reconstruction, or improvement offers greater protection to public water or the environment, and does not change a recreational activity to a land-based one; however, this expansion still cannot involve new underwater supports, an expanded footprint, or increased living space. A key condition for any work on these dwellings is the existence or installation of an approved sewage disposal system, and routine maintenance not involving work in the water will not require a permit.
