This bill proposes an amendment to the New York State Constitution regarding how vacancies in the offices of Comptroller and Attorney General are filled. Currently, these positions are elected at the same time as the Governor and serve the same term. The proposed changes specify that if a vacancy occurs, the legislature will provide a replacement until the next general election, which must be at least three months after the vacancy. At that election, a new Comptroller or Attorney General will be chosen to complete the remainder of the original term. Additionally, if the elected Comptroller or Attorney General declines to serve or dies before taking office, the legislature will also fill that vacancy until the next general election. The bill maintains the existing constitutional provisions about the Comptroller's duties to audit state accounts and revenues, and ensures that any state money payments or refunds require the Comptroller's audit. This amendment requires referral to the first regular legislative session after the next general election of assembly members and must be published for three months prior to that election.
