This bill proposes to amend the New York State Constitution regarding how vacancies in the offices of Comptroller and Attorney General are filled. Currently, these positions are elected at the same time as the governor and serve the same term. The proposed changes would create a more specific process for filling vacancies: if a vacancy occurs, the legislature would be responsible for filling the position until the next general election, which must be at least three months after the vacancy. At that election, a new Comptroller or Attorney General would be elected to serve the remainder of the original term. Additionally, if a Comptroller-elect or Attorney General-elect declines to serve or dies before taking office, the legislature would also provide a temporary replacement until the next general election.
