Bill Summary
AN ACT to amend the criminal procedure law, in relation to jury deliberations
AI Summary
This bill amends Section 310.30 of the criminal procedure law to allow judges more flexibility in providing written instructions to juries during deliberations. Specifically, the bill permits judges to provide written instructions about the elements of an offense, defense, or affirmative defense when requested by the jury. Before providing such written instructions, the judge must allow the attorneys for both the prosecution and defense to review the instructions, give them an opportunity to be heard, mark the instructions as a court exhibit, and read the instructions to the jury. This change aims to enhance jury comprehension by providing clear, written guidance about legal elements during their deliberation process. The bill is named the "Tiarah Poyau Act" and will take effect 120 days after becoming law. The modification builds upon existing law that already allows juries to request information or clarification during their deliberations, but now specifically authorizes written instructions about legal elements as a potential form of guidance.
