This bill requires that all parking violation enforcement devices be equipped with cameras capable of taking time and date-stamped photographs of vehicles at the time of a violation. The bill mandates that these photographs must accompany every parking violation ticket and must clearly display the vehicle and any relevant parking signs. The photographs must be stored by the relevant bureau and made available to the person charged with the violation upon request. The bill specifically stipulates that, to the extent possible, the photographs should not include identifiable images of the driver, passengers, vehicle contents, pedestrians, or cyclists. The use and dissemination of these photographs are strictly limited to establishing violation liability, collecting penalties, responding to court orders, or as otherwise required by law. The bill also modifies existing traffic law to require that parking violation notices include information about how a person can request the photograph of their alleged violation. The new requirements will take effect 180 days after the bill becomes law, giving government entities time to update their parking enforcement equipment and procedures.
