This bill empowers the commissioner of labor to issue stop-work orders against employers who misclassify employees as independent contractors or provide false information about their workforce to insurance companies. Under the proposed law, if the commissioner determines an employer has committed such violations, they must first send a written notice giving the employer 72 hours to address the issue. If the employer does not come into compliance, the commissioner can issue a stop-work order that halts all business operations at the sites where the violation occurred. The stop-work order remains in effect until the employer demonstrates compliance and pays any associated penalties. Employers have the right to request a hearing to contest the order within ten days of its issuance. The bill also includes additional provisions, such as requiring employers to pay affected employees their regular wages during the stop-work order period, imposing financial penalties for non-compliance (ranging from $1,000 to $5,000 per day), and creating a rebuttable presumption of unlawful retaliation if an employer takes adverse action against an employee who files a complaint. The law will take effect 180 days after its passage, giving employers time to adjust to the new requirements.
