Bill Summary

AN ACT to amend the labor law, in relation to issuing stop-work orders for misclassification of employees

AI Summary

This bill empowers the commissioner of labor to issue stop-work orders against employers who misclassify employees as independent contractors or provide false information about their workforce. If the commissioner determines an employer has committed such violations, they must first provide a written notice to the employer, which explains the violation, gives the employer 72 hours to address the issue, and informs them of their right to a hearing. If the employer does not come into compliance within 72 hours, the commissioner can issue a stop-work order that requires the cessation of all business operations at the sites where the violation occurs. The stop-work order remains in effect until the employer comes into compliance and pays any assessed penalties. Employers who fail to comply with the stop-work order can be fined between $1,000 and $5,000 per day of non-compliance. The bill also protects employees by requiring them to be paid their regular rate during the stop-work order period, and it includes a provision that prevents employers from retaliating against employees who file complaints. Additionally, the bill extends penalties to successor entities with similar ownership or leadership to the original violating business.
