Bill Summary

Prohibits the issuance of a certificate of inspection for a moped or motor vehicle that has been altered, installed, or otherwise modified in any way which will noticeably increase the noise emitted by the motor vehicle or moped above that emitted by the motor vehicle or moped as equipped from the factory, except for motorcycles and mopeds that do not exceed certain federal regulations. Effective 7/1/3000. (HD1)

AI Summary

This bill amends Hawaii's vehicle inspection regulations to prohibit the issuance of a certificate of inspection for any motor vehicle or moped that has been modified to produce noticeably more noise than it did when originally manufactured from the factory. Specifically, the bill adds language to Section 286-26 of Hawaii Revised Statutes requiring that during vehicle inspections, no certificate shall be issued if the vehicle's muffler has been altered, installed, or modified in a way that increases noise levels above the original factory specifications. The bill provides an exception for motorcycles and mopeds that comply with United States Environmental Protection Agency (EPA) noise regulations as specified in title 40 Code of Federal Regulations section 205.152. This means that while aftermarket modifications are generally prohibited if they increase noise, vehicles that meet specific federal noise standards will still be eligible for inspection. The bill is set to take effect on July 1, 3000, which appears to be a placeholder date typically used when the exact implementation date is not yet determined.
