This bill defines "abortion" as intentionally ending a pregnancy with an intention other than to increase the probability of a live birth, preserve the life or health of a child after live birth, remove an ectopic pregnancy, or remove a dead unborn child from a spontaneous miscarriage, accidental trauma, or criminal assault. It also defines "abortion-inducing drug" as any substance prescribed or dispensed with the intent of causing an abortion, including off-label uses of drugs like misoprostol and methotrexate, but excluding drugs prescribed for other medical reasons or for ectopic pregnancies or miscarriages. The bill prohibits "trafficking," which is defined as buying, selling, or delivering medicine, drugs, or substances illegally, specifically in the context of providing abortion-inducing drugs to someone intending to cause an unlawful abortion. Engaging in this trafficking or attempting to do so is classified as a felony, punishable by a fine of up to $100,000, up to ten years in prison, or both. However, the bill includes exceptions for pharmacists, manufacturers, and distributors who lawfully possess, sell, or distribute drugs for legitimate medical purposes, and it clarifies that it does not prohibit the use, sale, prescription, or administration of preventive contraception when used according to manufacturer instructions.
