This bill amends the state finance law to establish procedures and accountability measures for state agencies contracting with not-for-profit organizations. The bill defines a "noncompliant state agency" as one that fails to execute contracts within required time frames, specifically if for six of the last twelve months an agency has: (a) not submitted renewal contracts to the attorney general within the mandated timeframe, (b) failed to submit renewal contracts before their commencement, or (c) not fully executed a contract before its start date. When an agency becomes noncompliant, it must submit monthly reports to the state comptroller detailing unsubmitted contracts, reasons for delays, steps being taken to resolve issues, and estimated contract submission timelines. Additionally, within six months of becoming noncompliant, the agency must prepare a comprehensive report for the senate president and assembly speaker, describing efforts to improve internal processes, identify contracting barriers, retrain staff, and reform procurement procedures. The bill also modifies provisions around written directives, requiring them to include a state payment schedule and stipulating that late payments will be subject to interest, which aims to provide more transparency and financial accountability in state agency contracts with not-for-profit organizations.
