This bill modifies Oklahoma law regarding the Oklahoma Turnpike Authority's property acquisition and compensation process by requiring the Authority to provide written notice to property owners adjacent to planned turnpike projects and offering them two primary options: compensation or property acquisition. Specifically, property owners within 1,000 feet of a planned turnpike right-of-way can request compensation for damages including noise and light pollution, diminished property value, and loss of property enjoyment. If the property owner requests compensation and the Authority fails to reach an agreement within 180 days, the Authority must initiate a court action within an additional 90 days. The bill provides that if a court awards compensation more than 10% higher than the Authority's final offer, the property owner can recover attorney fees, appraisal fees, and expert witness fees. Alternatively, property owners can request that the Authority acquire their entire abutting property using the same legal process as right-of-way acquisition.
