This bill amends the New York State Executive Law to enhance enforcement of Minority and Women-owned Business Enterprise (MWBE) regulations by requiring the Empire State Development Corporation to hire independent MWBE consultant firms to help reduce contractor violations of Article 15-A. Specifically, if a contractor is found to be in violation of MWBE provisions, they will be mandated to retain an independent monitor who will investigate the circumstances of the violation, help the contractor rectify the issue, implement remedial action plans, and continuously oversee the contractor's compliance with MWBE requirements. The independent monitor will be responsible for providing regular reports to the assigned MWBE consultant about the contractor's progress and compliance. The bill will take effect 90 days after becoming law, with a provision that ensures any amendments made will be considered repealed when the original section is repealed.
