This bill amends the New York Executive Law to strengthen enforcement of Minority and Women-owned Business Enterprise (MWBE) regulations by requiring the Empire State Development Corporation to hire independent MWBE consultant firms to help reduce contractor violations of Article 15-A (which governs MWBE participation in state contracts). Specifically, if a contractor is found to be in violation of MWBE provisions, the director can mandate that the contractor hire an independent monitor who will investigate the circumstances of the violation, help the contractor correct the issues, implement remedial action plans, and continuously oversee the contractor's compliance with MWBE requirements. The monitor must provide regular reports on the contractor's progress to the assigned MWBE consultant. The bill will take effect 90 days after becoming law, with a provision that ensures these amendments will be repealed along with the original section of law when it is scheduled to be repealed.
