This bill introduces new regulations for the use of generative artificial intelligence (AI) in political advertisements and communications. The bill defines generative AI as a machine-based system that can create synthetic content like images, videos, audio, and text by emulating the characteristics of input data. It mandates that any political advertisement, electioneering communication, or media created by candidates, political committees, or parties that uses generative AI to depict a person doing something they did not actually do must include a prominent disclosure stating "Created in whole or in part with the use of generative artificial intelligence." For visual media, this disclosure must be easily readable, and for videos, it must appear throughout the AI-generated content. For audio-only media, the disclosure must be clearly spoken at the beginning and end of the content. The bill allows candidates whose likeness is misrepresented to seek legal relief, including injunctions and damages. There are exceptions to these requirements for news broadcasts, good-faith media broadcasts, publications that clearly state the content is not an accurate representation, and satirical or parody content. The law is set to take effect on November 1, 2025, and aims to increase transparency and accountability in political media created using AI technology.
