This bill allows foster care providers who are lactating females to breastfeed a child under two years old under specific conditions. To do so, the foster care provider must first obtain authorization from the Oklahoma Department of Human Services (DHS) and, when possible, receive prior written informed consent from the child's biological parent. The bill requires the Director of Human Services to develop rules that will outline the implementation of this provision. The law will become effective on November 1, 2025, and will be codified as Section 1-7-117 of Title 10A in the Oklahoma Statutes. By allowing breastfeeding in foster care settings under controlled and consensual circumstances, the bill aims to potentially support infant nutrition and maintain biological bonding when appropriate and approved by relevant authorities.
