This bill establishes the Educators' Professional Liability Insurance Program (EPLIP) to provide liability coverage for all public and charter school employees, both full-time and part-time. The program will offer up to $2 million in liability coverage per occurrence and will be administered by the Office of Management and Enterprise Services (OMES), which is authorized to either contract with a private insurer, create a self-insured risk pool, or use a combination of both methods. OMES must select the insurance carrier through a competitive process and will be responsible for creating rules to implement the program. The Legislature will be required to provide annual appropriations to cover the program's costs and premiums. School districts and state education agencies must notify eligible employees about the program, including informing them that coverage is automatically provided as part of their employment, with initial notification occurring at hiring and then annually thereafter. Importantly, the bill does not exempt school districts from existing obligations or modify the Governmental Tort Claims Act. The program is set to become effective on November 1, 2025, providing school employees with comprehensive liability protection at no additional cost to them.
