This bill amends Oklahoma's existing law regarding trespassing on critical infrastructure facilities by expanding the definition of prohibited activities and adding new types of facilities to the legal definition. The bill modifies the penalties for trespassing, entering, or loitering on these facilities without permission, introducing a new definition of "loitering" as standing or waiting around idly without an apparent purpose. For simple trespassing, the punishment remains a misdemeanor with potential fines up to $1,000 and/or six months in county jail. However, if the trespasser intends to damage, destroy, or impede facility operations, the offense becomes a felony with potential fines up to $10,000 and/or one year in state prison. The bill significantly expands the list of critical infrastructure facilities to include prisons, county-owned properties like courthouses and detention centers, in addition to the existing comprehensive list of industrial, utility, and transportation-related facilities. Organizations found conspiring to commit these offenses can face fines ten times the standard amount. The bill will become effective on November 1, 2025, providing ample time for stakeholders to understand and prepare for the new legal requirements.
