The bill requires that investigation reports remain publicly accessible, regardless of whether a facility's license is currently active or inactive. It maintains the existing provisions that allow the Department of Human Services to investigate child care facilities at any reasonable time, including the ability to require facilities to provide information about children in their care. The bill preserves the current process for handling complaints, which includes conducting full investigations when allegations are received, documenting complaints, providing written notifications to facilities, and requiring correction of violations that impact children's health, safety, or well-being. If a facility fails to correct violations, the Department retains the authority to issue emergency orders, revoke licenses, or deny license applications. In cases of substantiated heinous abuse, the bill mandates prompt notification to facility owners, operators, and child care resource organizations, with a requirement that facility owners notify parents within 72 hours. The bill also maintains confidentiality protections for sensitive information while allowing for summary reports that help parents evaluate facilities without disclosing specific identities. The legislation will become effective on November 1, 2025.
