This bill amends the Texas Health and Safety Code to expand existing exemptions from boiler registration and inspection requirements by adding two new categories of boilers that will not be subject to regulation: (1) boilers that are components of medical devices regulated by the U.S. Food and Drug Administration (FDA), with specific size limitations including a maximum inside shell diameter of 16 inches, no more than 20 square feet of heating surface, a gross volume under five cubic feet (excluding casing and insulation), and an allowable working pressure of 100 pounds per square inch gauge; and (2) unfired pressure vessels in an autoclave. These exemptions are designed to reduce regulatory burden for medical and scientific equipment while maintaining safety standards. The bill will take effect on September 1, 2025, and builds upon existing exemptions for boilers owned by the federal government, pressure vessels, manually fired miniature boilers used for hobby purposes, boilers designed for atmospheric pressure, steam cookers, and espresso machines. The proposed changes aim to provide more flexibility for medical and research equipment while ensuring that smaller, specialized boilers are not unnecessarily subjected to comprehensive inspection requirements.
