This bill amends the New York State Finance Law to require that when government agencies evaluate "best value" procurement contracts, they must now consider as a quantitative factor whether the commodities or services being offered were manufactured or will be performed by members of a labor organization. Currently, the law allows agencies to use quantitative factors for small businesses, minority- or women-owned businesses, and service-disabled veteran-owned businesses in contract evaluations. The new provision adds labor union membership as another quantitative factor that can be considered when awarding service contracts. By doing so, the bill aims to provide potential additional consideration for businesses and services associated with labor unions during the procurement process. The amendment will take effect 30 days after becoming law, and the changes will be subject to the existing provisions regarding the section's potential future repeal.
