This bill, an emergency measure, prohibits the use of public funds and state facilities for gender transition procedures, which are defined as medical or surgical services aimed at affirming an individual's perception of their gender if it differs from their biological sex, including surgeries that alter physical characteristics or the use of puberty-blocking drugs, cross-sex hormones, or other drugs to suppress puberty or promote features of the opposite sex. Importantly, this definition excludes behavioral health care, medications for depression and anxiety, treatments for precocious or delayed puberty, services for individuals with disorders of sex development (DSD), and treatment for complications arising from gender transition procedures or any condition that poses an imminent danger to life or major bodily function. "Public funds" are defined as any state money, including appropriations and revenue generated by state agencies. The bill explicitly states that public funds cannot be used for these procedures, the state Medicaid program will not reimburse for them, and no state property or facilities can be used to provide them, with any state officer or employee intentionally violating these provisions facing a misdemeanor charge.
