This bill requires medical marijuana commercial growers licensed as indoor grow facilities within municipal limits to submit an odor control plan by January 1, 2027. The plan must include detailed facility information (such as name, contact details, and operational hours), odor emissions information (including floor plans and odor-emitting activities), and odor mitigation best management practices. If a medical marijuana business receives three or more odor nuisance complaints within a 30-day period, they will also be required to submit an odor control plan to the Oklahoma Medical Marijuana Authority. For renewal applications, businesses must either submit an updated odor control plan if the existing one is inconsistent or provide an affidavit confirming the current plan is still applicable. The bill also updates existing licensing requirements by adding this new odor control plan submission as a mandatory step for commercial grower license applications. The Oklahoma Medical Marijuana Authority is directed to create rules to implement these new requirements, and the bill will become effective on November 1, 2025, giving businesses time to prepare and develop their odor control strategies.
