This bill amends the existing Fair Pay for Construction Act by expanding the list of construction types exempt from the act's provisions. Specifically, the bill adds municipal road construction to the existing exemptions of highway, railroad, and turnpike construction. The bill also updates a statutory reference from Section 2 to Section 222. Additionally, the bill reaffirms certain public policy provisions that render void any contract provisions attempting to: 1) make a construction contract subject to another state's laws or require dispute resolution in another state, or 2) disallow or alter the rights of contractors, subcontractors, sub-subcontractors, or material suppliers under the act. The bill maintains existing exemptions for single-, two-, three-, and four-family dwelling contracts, as well as various types of infrastructure construction like roads, bridges, utilities, traffic control, drainage, sanitary sewer, and waterline projects. The bill is set to become effective on November 1, 2025, providing ample time for stakeholders to understand and prepare for the changes.
