This bill modifies the Oklahoma Indigent Defense System's procedures for determining eligibility for court-appointed legal representation. The bill eliminates the previous requirement that indigent defendants who have been released on bond must contact three private attorneys and prove they cannot obtain legal counsel. It also removes the $40 non-refundable application fee that was previously mandatory. Instead, the bill establishes a rebuttable presumption of eligibility for indigent representation if a defendant is unable to post bail, with the primary factor to rebut this presumption being an income above the state's poverty threshold. The bill maintains that the application must still be submitted under oath, with potential prosecution for false statements. The determination of indigency will continue to be initially made by the Chief Judge of the Judicial District, subject to review by the Presiding Judge, and guided by rules promulgated by the Court of Criminal Appeals. The changes aim to make obtaining court-appointed legal representation easier and more accessible for low-income defendants. The bill will become effective on November 1, 2025.
