This bill creates the Oklahoma Uniform Unlawful Restrictions in Land Records Act, which provides a mechanism for property owners and owners associations to remove discriminatory or otherwise unlawful restrictions from land records. The bill defines an "unlawful restriction" as a prohibition or condition in a document that interferes with property transfer, use, or occupancy based on characteristics like race, color, religion, national origin, sex, familial status, or disability, and which violates state or federal law. Individual property owners can submit an amendment to remove such restrictions from their specific property, while owners associations can remove unlawful restrictions from governing instruments without requiring a member vote. The amendment process requires identifying the owner, the property, and the original document containing the restriction, and must include a specific statement explaining the removal. County clerks are required to record these amendments and cross-reference them to the original documents, and they are protected from liability for doing so. The bill also specifies that removing an unlawful restriction does not affect the validity of other non-unlawful restrictions and does not republish restrictions that would have otherwise expired. The act will become effective on November 1, 2025, and modifies certain provisions of the Electronic Signatures in Global and National Commerce Act.
