This bill prohibits lodging establishments in Hawaii from providing personal care products (defined as shampoo, hair conditioner, and bath soap) in small plastic containers (containers of 6 ounces or less) within guest rooms, room spaces, and public bathrooms. The prohibition will be implemented in two phases: January 1, 2027, for lodging establishments with more than 50 rooms, and January 1, 2029, for establishments with 50 or fewer rooms. Lodging establishments may still use bulk dispensers of personal care products or provide non-plastic packaged products upon request in designated areas outside of guest rooms and bathrooms. The bill defines "lodging establishment" broadly to include hotels, motels, resorts, bed and breakfasts, and transient rentals, while excluding hospitals, prisons, shelters, and long-term rentals. Violations will result in civil penalties of $500 for the first offense and $2,000 for subsequent offenses, with each day of continued violation considered a separate offense. The legislation stems from concerns about plastic pollution, noting that globally only less than 10% of plastics are recycled and that plastic waste poses significant environmental and health risks. The bill allows local counties to implement even stricter regulations and empowers the department to adopt necessary implementation rules.
