This bill introduces new provisions for building permit exemptions in Hawaii for certain maintenance, repair, and construction activities located outside special management areas. Specifically, the bill allows exemptions for three main types of work: (1) like-for-like repairs that don't involve electrical, plumbing, or mechanical installations, (2) small Group U structures (uninhabited structures like sheds, carports, and agricultural buildings) under 1,000 square feet, and (3) interior remodeling that doesn't change the building's square footage, room layout, or use. For larger structures or more significant work, property owners must submit plans and provide written notice to the county agency. The bill requires that no work can commence until the county agency confirms the project doesn't conflict with flood management standards, and the agency must certify the work within 30 days of receiving notice. The county fire department and building permitting agency are granted the right to investigate exempted work for compliance, and can seek a court warrant if entry is refused. The bill explicitly states that the State and counties are not liable for claims arising from such work unless there is gross negligence, and it does not exempt projects from underlying zoning or other regulatory requirements. The provisions are set to take effect on July 1, 2050, and aim to streamline the permitting process for minor construction and maintenance activities.
