This bill proposes to create a new section in Hawaii's laws that provides exemptions from county building permit requirements for certain maintenance, repair, and construction activities located outside of special management areas. Specifically, the bill would exempt like-for-like repairs that don't involve electrical, plumbing, or mechanical work; Group U occupancies (uninhabited structures such as garages, sheds, agricultural buildings) under 1,000 square feet; and interior remodeling that doesn't change the building's square footage, room configuration, or use. For larger structures or more substantial work, property owners must submit plans and provide written notice to the county agency, and no work can commence until the agency confirms that the project doesn't conflict with flood management standards. The county fire department and building permitting agency would have the right to inspect the work, and property owners who refuse entry could be subject to a court warrant. The bill explicitly states that the exemptions do not override existing lease conditions, zoning requirements, or other regulatory standards, and that the state and counties are not liable for claims arising from such work unless there is gross negligence. The proposed law would take effect on July 1, 2050, and would provide a streamlined approach to minor construction and maintenance activities while still maintaining basic safety and regulatory oversight.
