This bill expands the Lindsey Nicole Henry Scholarships for Students with Disabilities Program by adding children with incarcerated parents to the list of eligible students who can receive scholarships to attend private schools. Currently, the program allows students with disabilities who have an Individualized Education Program (IEP) or Individualized Service Plan (ISP) to receive scholarships. The new provision allows students with at least one parent who is incarcerated to also qualify for these scholarships. Parents or legal guardians seeking a scholarship for a student with an incarcerated parent must provide documentation verifying the parent's incarceration, including an active Department of Corrections inmate number. The scholarship amount will be calculated based on state aid factors and disability weights, and cannot exceed the private school's tuition and fees. The bill maintains existing program requirements, such as the private school meeting certain eligibility criteria, and requires school districts to notify parents of these scholarship options. The changes will take effect on November 1, 2025, expanding educational opportunities for students with disabilities and those with incarcerated parents.
