AI Summary

This bill establishes the Civil Rights Restoration Act, which introduces several significant changes to firearm licensing and related legal procedures in New York. The bill provides enhanced protections for individuals in firearm-related proceedings, including requiring clear and convincing evidence in such cases, ensuring a right to counsel, and mandating written notification when someone is reported to law enforcement databases that could impact their firearm rights. It expands the definition of immediate family for firearm transfers to include parents and siblings, exempts individuals with sincere religious beliefs from providing photographs for firearm licenses, and prohibits the use of medical records for routine law enforcement reporting about firearm ownership. The bill also introduces transparency measures, such as requiring law enforcement agencies to publish an annual inventory of destroyed firearms and preventing the automatic registration of ammunition sellers. Additionally, it imposes penalties for falsely reporting involuntary mental health commitments and provides mechanisms for individuals to challenge incorrect reports in state and federal databases. The legislation aims to protect Second Amendment rights while maintaining public safety considerations, offering more procedural safeguards and transparency in firearm-related legal processes.
