This bill modifies Section 201H-47 of Hawaii Revised Statutes to explicitly exempt transfers of Hawaiian home lands from the existing transfer restrictions for real property under Chapter 201H housing development programs. The new subsection (l) specifically states that these transfer restrictions will not apply to transfers of Hawaiian home lands, which are lands designated for Native Hawaiians under the Hawaiian Homes Commission Act of 1920. This exemption means that transfers of Hawaiian home lands will not be subject to the complex repurchase and appreciation-sharing rules that currently apply to other affordable housing properties developed by the HHFDC. The bill will take effect upon approval and is designed to be a permanent amendment, with a provision ensuring the changes will not be automatically repealed in 2028 when the original statute is scheduled for reenactment.
