This bill addresses environmental review processes for certain ocean recreation and coastal area activities by allowing long-standing commercial operations that are currently permitted to continue operating for up to one year while undergoing environmental review, even if their permits are being challenged. Specifically, activities permitted under Chapter 200 of Hawaii Revised Statutes that have been renewed within the past twelve months can continue operations while the appropriate agency determines whether an environmental assessment or impact statement is required, with the condition that no new construction, grading, dredging, or structural modifications occur. The bill provides a temporary solution to recent court decisions that have broadened the definition of "action" in environmental review, which could potentially force established commercial operations to cease functioning. Additionally, the bill allows the permit holder to renew their existing permits while the environmental review is ongoing, provided they continue to meet all regulatory requirements. The provisions of this bill will be in effect from July 1, 3000, until June 30, 2027, effectively providing a long-term but time-limited protection for these commercial operations during environmental review processes.
