This bill creates a new legal requirement for defendants convicted of causing the death of a parent or legal guardian through negligent vehicle operation while under the influence of drugs or alcohol. Specifically, the bill mandates that such defendants provide financial support to the surviving minor children of the victim until the children reach either 18 years of age or 19 years if still enrolled in high school. The court will determine the appropriate amount of financial support by considering factors such as the child's financial needs, the surviving parent's resources, the child's standard of living, educational needs, custody arrangements, and child care expenses. Payments will be made to the court clerk, who will then remit the funds to the surviving parent or legal guardian within three working days. If the defendant is incarcerated and unable to make restitution, they will have up to one year after release to begin payments. The bill also specifies that if a civil lawsuit has already been filed and fully satisfied, restitution will not be ordered, and if restitution is ordered and a subsequent civil judgment is obtained, the restitution will be offset by the amount of the civil judgment.
