Bill Summary

A BILL IN THE COUNCIL OF THE DISTRICT OF COLUMBIA To amend the District of Columbia Workers’ Compensation Act of 1979 to provide that the payment or award of compensation under the workers’ compensation law of any other state shall not bar a claim for compensation under the District’s workers’ compensation law for the same injury or death; provided, that any such award under the District’s workers’ compensation law shall be reduced by the amount of compensation received or awarded under the workers’ compensation law of any other state.

AI Summary

This bill amends the District of Columbia Workers' Compensation Act to clarify and improve workers' compensation benefits for employees who have received compensation from another state. Specifically, the bill provides that receiving workers' compensation benefits from another state will not prevent an employee from also filing a claim for the same injury under the District of Columbia's workers' compensation law. When an employee receives compensation under the District's law, any award will be reduced by the amount of compensation already received from another state's workers' compensation system. The bill applies retroactively to all claims that were pending as of the effective date of a previous emergency amendment (Bill 24-841 from June 6, 2022) and to all claims filed after that date. This means that workers who have been injured on the job and have already received some compensation from another state can still seek additional support from the District of Columbia, with the total compensation being adjusted to prevent double recovery. The bill will take effect after mayoral approval and a 30-day congressional review period, which is standard for District of Columbia legislation.
