Bill Summary
AN ACT IN THE COUNCIL OF THE DISTRICT OF COLUMBIA To amend the District of Columbia Workers’ Compensation Act of 1979 to provide that the payment or award of compensation under the workers’ compensation law of any other state shall not bar a claim for compensation under the District’s workers’ compensation law for the same injury or death; provided, that any such award under the District’s workers’ compensation law shall be reduced by the amount of compensation received or awarded under the workers’ compensation law of any other state.
AI Summary
This bill amends the District of Columbia Workers' Compensation Act of 1979 to clarify and expand workers' compensation benefits for employees who have received compensation from another state for the same workplace injury. Specifically, the bill ensures that if an employee receives workers' compensation benefits from another state, they can still file a claim for compensation in the District of Columbia. When such a claim is successful, the award will be reduced by the amount of compensation already received from the other state's workers' compensation system. This provision applies to both existing claims that were pending as of June 28, 2022, and to any new claims filed after that date. The bill aims to provide more flexibility and fairness for workers who may have been injured in one state but are seeking additional compensation or support in the District of Columbia. The legislation will take effect after approval by the Mayor and completion of a 30-day congressional review period, which is standard for District of Columbia laws.
