Bill Summary

Prohibits the erection, placement, construction, or maintenance of an encampment within one hundred feet from the property line of a pre-K-12 public or private school or school facility on public or private property. Effective 7/1/3000. (HD1)

AI Summary

This bill creates a new law establishing a "buffer zone" within 100 feet of pre-K-12 public and private schools, where setting up an encampment (defined as a tent, makeshift shelter, or temporary habitation structure) would be prohibited. Violations of this prohibition would be considered a petty misdemeanor, and individuals found in violation could also potentially face trespassing charges. The bill allows schools and law enforcement to collaborate in identifying and removing such encampments, with law enforcement required to provide displaced individuals information about temporary housing and homelessness assistance programs. Additionally, law enforcement personnel must take and store the personal belongings of displaced individuals, to be returned to them later. The legislature's rationale for the bill is that encampments near schools can create safety, health, and environmental hazards that might negatively impact students, staff, and surrounding communities. The bill is designed to address these concerns by creating a clear legal mechanism to prevent encampments in close proximity to educational institutions. The law is set to take effect on July 1, 3000 (which appears to be a placeholder date).
